Unit I

Introduction to Intellectual Property: Overview of Intellectual Property (IP) and its significance in creative industries, Types of intellectual property: patents, copyrights, trademarks, and design rights, Legal framework and theories underlying intellectual property rights, Importance of IP for Small and Medium Enterprises (SMEs) and creative professionals, Monetization strategies for intellectual property, Career opportunities in the field of intellectual property

Unit II

Patents: Elements of patentability: novelty, non-obviousness (inventive steps), industrial application, non- patentable subject matter and registration procedures, Rights and duties of patentees, including assignment and licensing, Restoration of lapsed patents and surrender and revocation procedures, Patent infringement, remedies, and penalties, Roles of the Patent Office and Appellate Board in patent law enforcement

Unit III

Copyrights: Nature and scope of copyright protection, Subject matter of copyright: original literary, dramatic, musical, and artistic works, cinematograph films, and sound recordings, Copyright registration procedures and term of protection, Ownership, assignment, and licensing of copyright, Infringement, remedies, and penalties in cases of copyright violation, Distinction between copyright and related rights, piracy in cyberspace, and copyrightability of movie titles

Unit IV

Trademarks: Concept of trademarks and their importance in branding, Various types of trademarks: brand names, logos, symbols, etc., Registrability criteria and procedures for trademark registration, Rights of trademark holders and assignment and licensing of trademarks, Trademark infringement, remedies, and penalties, Functions of the Trademarks Registry and Appellate Board in trademark law enforcement

Unit V

Other Forms of IP in Media Industries: Design protection: meaning, concept, and registration procedures, Layout design protection and its implications for creative industries, Analysis of India’s National IP Policy 2016 and government schemes promoting intellectual property rights, Examination of career opportunities in the field of intellectual property, Discussion on contemporary issues and case studies regarding intellectual property rights in the media industry

Objectives and Outcomes

This course provides a comprehensive exploration of intellectual property rights (IPRs) within the context of creative industries. Participants will delve into the legal frameworks governing various types of IPRs, including patents, copyrights, trademarks, and related rights, with a focus on their significance for small and medium enterprises (SMEs). Through theoretical analysis and practical case studies, students will learn to evaluate the patentability of creative innovations, assess copyright infringement, navigate trademark registration processes, and understand the broader implications of IPRs on the media industry. Additionally, the course will examine India’s National IP Policy, government schemes, and career pathways in the field of intellectual property.

CO6: Evaluate the impact of intellectual property rights on the media industry, critically assessing India’s National IP Policy, government initiatives, and career prospects in intellectual property, backed by case studies and contemporary scenarios.
